{"id":8039,"date":"2021-10-21T12:19:02","date_gmt":"2021-10-21T11:19:02","guid":{"rendered":"http:\/\/qpol.qub.ac.uk\/?p=8039"},"modified":"2021-10-21T12:19:02","modified_gmt":"2021-10-21T11:19:02","slug":"proposals-and-the-protocol-where-do-the-eu-proposals-leave-us","status":"publish","type":"post","link":"https:\/\/blogs.qub.ac.uk\/qpol\/proposals-and-the-protocol-where-do-the-eu-proposals-leave-us\/","title":{"rendered":"Proposals and the Protocol: where do the EU proposals leave us?"},"content":{"rendered":"\n<p>It would not be an exaggeration to say that the&nbsp;<a href=\"https:\/\/ukandeu.ac.uk\/video-audio\/protocol-on-ireland-northern-ireland-video\/\" target=\"_blank\" rel=\"noopener\">Protocol<\/a>&nbsp;has been the subject of near blanket coverage this week in Northern Ireland. Speculation about Lord Frost\u2019s&nbsp;<a href=\"https:\/\/ukandeu.ac.uk\/reflections-frost-speech-on-protocol\/\" target=\"_blank\" rel=\"noopener\">speech in Lisbon<\/a>&nbsp;on Monday; reaction to Frost\u2019s speech on Tuesday; speculation about Vice-President&nbsp;<a href=\"https:\/\/ukandeu.ac.uk\/the-facts\/who-is-maros-sefcovic\/\" target=\"_blank\" rel=\"noopener\">\u0160ef\u010dovi\u010d<\/a>\u2019s proposals on Wednesday; reaction to \u0160ef\u010dovi\u010d\u2019s proposals on Thursday\u2026 So, it\u2019s Friday now. Frost and \u0160ef\u010dovi\u010d are meeting in Brussels.<\/p>\n\n\n\n<p>All being well, they will agree to move into more detailed, intensive talks. This is a good time for a brief pause to reflect on where all this has left us.<\/p>\n\n\n\n<p>What Frost\u2019s speech managed to do was primarily to set the tone and trend for how he envisages the UK-EU relationship from now on. Expect more competition and less collaboration. Expect the UK to diverge from EU rules.<\/p>\n\n\n\n<p>Even before we get into the specific and political difficulties around the Protocol, that context makes operating the&nbsp;<a href=\"https:\/\/ukandeu.ac.uk\/article-16-eu-protocol\/\" target=\"_blank\" rel=\"noopener\">Protocol<\/a>&nbsp;all the more difficult for NI, because any workable solution needs it to be able to find balance in its unique position between the EU and Great Britain.<\/p>\n\n\n\n<p>When there is turbulence in that relationship, then that balance is near-impossible to maintain.<\/p>\n\n\n\n<p>What the&nbsp;<a href=\"https:\/\/ukandeu.ac.uk\/the-facts\/what-is-the-european-commission\/\" target=\"_blank\" rel=\"noopener\">EU Commission<\/a>&nbsp;put forward in terms of proposals on Wednesday was never going to be sufficient alone to find such a balance. However, it can be understood as an effort to try to reduce some of the issues that have caused difficulties and disturbance for Northern Ireland\u2019s economy.<\/p>\n\n\n\n<p>These proposals&nbsp;<a href=\"https:\/\/ec.europa.eu\/commission\/presscorner\/detail\/en\/ip_21_5215\" target=\"_blank\" rel=\"noopener\">take the form<\/a>&nbsp;of four non-papers and an annex.<\/p>\n\n\n\n<p>The UK Government was clear that it did not want the EU to put down a \u2018take it or leave it\u2019 offer, and these non-papers are evidently not that.<\/p>\n\n\n\n<p>\u0160ef\u010dovi\u010d described them in his press conference on Wednesday as \u2018direct, genuine response to concerns raised\u2019 by political representatives, business and civil society in Northern Ireland.<\/p>\n\n\n\n<p>As such, they are not detailed or technical solutions per se, but rather outline suggestions or ambitions as to how things might improve. And the examples and the factsheets that have gone out with the announcements might be understood as \u2018how things could be\u2019 rather than a promise of what will come.<\/p>\n\n\n\n<p>\u0160ef\u010dovi\u010d dangled the prospect of 80% reduction in checks on SPS products and of 50% reduction on customs paperwork, but, well, there is a loud \u2018but\u2019 that goes along with that.<\/p>\n\n\n\n<p>Each of the four non-papers cover a different theme: SPS issues (around plant and animal products and health), customs, medicines and stakeholder engagement. And each follows a similar structure: the issue; the legal framework and conditions (and EU interests); possible solutions; conditions and safeguards.<\/p>\n\n\n\n<p>These allow the EU to show that it has recognised some of the concerns raised from NI and from the UK Government (e.g. in its July Command Paper).<\/p>\n\n\n\n<p>They also offer an opportunity for the EU to set out the problem as it sees it, which often includes pointed mention of failures and omissions on the part of the UK government.<\/p>\n\n\n\n<p>The possible solutions included certainly go further than we have seen before from the EU.
