{"id":3470,"date":"2017-09-19T16:04:00","date_gmt":"2017-09-19T15:04:00","guid":{"rendered":"http:\/\/qpol.qub.ac.uk\/?p=3470"},"modified":"2017-09-19T16:04:00","modified_gmt":"2017-09-19T15:04:00","slug":"legatum-institute-solution-problematic","status":"publish","type":"post","link":"https:\/\/blogs.qub.ac.uk\/qpol\/legatum-institute-solution-problematic\/","title":{"rendered":"Legatum Institute\u2019s solution for the Brexit border is highly problematic"},"content":{"rendered":"\n<p>The paper from the Legatum Institute\u2019s \u2018Special Trade Commission\u2019 on what it terms&nbsp;<a href=\"http:\/\/www.li.com\/activities\/publications\/mutual-interest-how-the-uk-and-eu-can-resolve-the-irish-border-issue-after-brexit\" target=\"_blank\" rel=\"noopener noreferrer\">\u2018the Irish border issue\u2019<\/a>&nbsp;is to be welcomed for two reasons. The first is that the paper\u2019s existence indicates this subject is of interest in London (and the&nbsp;<a href=\"https:\/\/www.theguardian.com\/commentisfree\/2017\/jul\/18\/brexit-british-business-leaders-legatum-eu\" target=\"_blank\" rel=\"noopener noreferrer\">well-publicised connections<\/a>&nbsp;of the Legatum Institute means it is likely to have traction). In actual fact, parts of this paper (on \u2018trusted traders\u2019 for example) already appear to have had an airing in&nbsp;<a href=\"https:\/\/www.gov.uk\/government\/publications\/northern-ireland-and-ireland-a-position-paper\" target=\"_blank\" rel=\"noopener noreferrer\">the UK Government Position Paper on Northern Ireland<\/a>.<\/p>\n\n\n\n<p>The second reason is that it gives those of us with a close and direct interest in this topic an opportunity to correct some of its most egregious misperceptions regarding the Irish border and Northern Ireland, and, indeed, of the fundamentals of European integration, international trade law and customs practice.<\/p>\n\n\n\n<p>&nbsp;<\/p>\n\n\n\n<p><strong>Opportunities and solutions?<\/strong><\/p>\n\n\n\n<p>Let us begin with the fundamental reason why the Irish border happens to be an \u2018issue\u2019 in the Brexit negotiations. The paper presents concerns about the border as being merely ones of commerce and logistics, with a hint of security risk thrown in. But no \u2018solution\u2019 to the border \u2018issue\u2019 has substantive credibility or viability if it is composed with such disregard for the rich and multi-layered cross-border relations that have flourished here as a result of the peace process and EU membership.
